The main co-ordinator of the policies for combating trafficking is the Ministry of the Interior of the Czech Republic (MI).
Its Security Policy Department has been tasked to act as the National Rapporteur. The role of the National Rapporteur is to monitor and analyse the situation in the field. The activities of the National Rapporteur are guided by the National Strategy for Combating Trafficking in Human Beings (currently for the 2008–2011 period); every year the National Rapporteur issues a Status report on trafficking in human beings in the CR.
MI’s Crime Prevention Department is implementing the Support and Protection Programme for Victims of Trafficking in Human Beings, which provides health care, social and legal assistance, as well as accommodation and facilitation of the return to the country of origin. Trafficked persons need to co-operate with the Prosecution, Law Enforcement and Judicial Authorities (the PEJA) in order to be eligible for participation in the Programme.
If the trafficked persons decide to co-operate with the PEJA, they can be granted a Long-Term Residence Permit for the Purpose of Receiving Protection in the Territory. Pursuant to § 42e of Act No 326/1999 Coll., on the Residence of Aliens in the Territory of the Czech Republic, the probable victims of the crime of trafficking in human beings have a reflection period of one month to decide whether they wish to co-operate with the PEJA. The decision on the award of a Long-Term Residence Permit for the Purpose of Receiving Protection in the Territory is taken by the Asylum and Migration Policy Department at the MI.
The Ministry of Labour and Social Affairs of the Czech Republic is responsible for Labour Law compliance inspections (regional Labour Inspectorates and Labour Offices).
As from 1 January, Act No 40/2009 Coll., the Criminal Code, became effective. The Act governs the crime of trafficking in human beings.
